What is the action about?
The Banksia Hill class action aims to:
- Compensate current and former detainees for the unlawful conditions and/or practices they were subject to in juvenile detention.
- Engender comprehensive reform to ensure youth justice in Western Australia is ‘fit for purpose’.
- Realise the rehabilitative potential of detention through trauma-informed, culturally adapted, and/or age-appropriate models of behaviour management.
“The themes are invariably the same: excessive lockdowns; punitive, inhumane, and degrading regimes; staff shortages; and a decrease in services.”
– Denis Reynolds, former President of the Children’s Court, and Neil Morgan, former OICS inspector.
